Acknowledgement of service?
Please help as I am confused with this acknowledgement of service.(The time for file a defence is increased from 14 to 28 days from the date of service of your particulars of claim).Does this statement propose that they have 28 days from the date the claim was made or 28 days from the date they sent the acknowledgement of service?
Many gratefulness in advance and UK singular please.
Answers:
28 days from the date the Particulars of Claim were served. The statement is a layman's explanation of Civil Procedure Rule 15.4(1):
(1) The general rule is that the interval for filing a defence is –
(a) 14 days after service of the fine points of claim; or
(b) if the defendant files an acknowledgment of service under Part 10, 28 days after service of the particulars of claim. Source(s): http://www.justice.gov.uk/civil/procrule…
